I'm sure I told them to take taxes from the NJ one but they only withheld federal. Never told them to withhold the taxes at all for the NY one. I'm assuming since neither state got their share of my winnings I'll need to file non resident returns in both states? This may be one year I might look into having a tax accountant do my taxes. Not worth the aggravation!

    I believe you don't need to file a State return for those states since your not a resident. I've only filed out of state returns to get money back that was automatically withheld.

    Thanks Natalie. I'll do some research. Just started thinking about taxes for the year and already my head hurts. At least I don't have to deal with all the college part for my daughter anymore but it was nice having her as a dependent while it lasted!

    Tax time

    I just looked on Louisiana web site and found this.
    So does this mean you only have to file if you want your money back?

    Who must file
    Louisiana residents, part-year residents of Louisiana, and nonresidents with income from Louisiana sources who are required to file a federal income tax return must file a Louisiana Individual Income Tax Return.

    And: Nonresident and Part-Year Resident Individual Income Tax
    Nonresident and part-year resident taxpayers who are required to file a federal individual income tax return are required to file a Louisiana income tax return, IT-540B, reporting all income earned from Louisiana sources. The calculation for the IT-540B requires that a taxpayer report all income from all sources in order to determine a ratio of Louisiana adjusted gross income to Federal adjusted gross income. Only income earned from Louisiana sources, however, is taxed.
    Gambling winnings earned in Louisiana is considered to be Louisiana sourced income. A nonresident who received gambling winnings from Louisiana sources and who is required to file a federal income tax return must file a Louisiana return reporting the Louisiana income earned. If the amount withheld is overpaid, a refund of the difference will be issued or credited to the tax liability for the following year, based upon the taxpayer's return.

    Kim,
    I'd strongly recommend a paper return vs. electronic. When I did it, you had to have at least one return on file in the past with the state to do the electronic.

    Keep multiple copies. Keep multiple copies. Did I say keep multiple copies.

    I don't think anyone read my post on filing multiple times. What a fiasco.

    Is that casino located on sovereign tribe land? If so, they might not follow the laws like non sovereign locations. Warren would know.

    Yeah thats gotta be it gary ...donna got a handy at Delta downs a little while back .but didnt remember at what rate she was taxed at by the state on the $$$ she won . we will have to see what our tax prepairer says about it here in a few weeks when we go do the return for last year

    So researching state taxes in the two non resident states I won HPs in (NY and NJ), it looks like only lottery wins are considered income sources in NY state so I won't need to file a non resident return for NY. Got this info from the NY State Dept of Taxation and Finance.

    Still researching NJ but pretty sure I may have to file a non resident return there.
