View Full Version : IRS holding Canadian gambling refunds.....until December 2016!!!!!

Happy Friday!

I am hoping someone can shed some insight onto why on earth the IRS still has not issued refunds. I filed my tax return in February 2015, used an IRS approved accountant in Canada. I have received NO information from the IRS in the form of a letter to tell me that the 1040NR is incomplete or that there is an issue with my return. I have made several phone calls to inquire to where my return is. The customer service agent I spoke with in July told me that my return would be issued in November. The reason for the delay is that they are investigating Casino's to ensure they have reported the money they have withheld from hand pays. I called again today and was on hold for 43 minutes.....I was told today by a very angry man that it may now be December 2016 - excuse my language but WTF - seriously. I asked him why is my money being withheld and his response was - I have no idea and nobody else will be able to tell you either. I asked him if there was a number I could call or an address I could send an inquiry to and he told me to look on the internet. He was quite rude and I told him, I am not mad at you, I am frustrated that my money is being withheld and that nobody has any answers. Sorry to ramble on, but I am pretty angry about this and I find it frustrating. This whole situation puts a damper on my upcoming trip.

If anyone(Canadians) has had the same experience and is also waiting for their refund - please share. Surely there must be somebody that I can contact that will be able to provide a reasonable explanation. Is this even legal...what happened to the treaty between the US and Canada?

On a side note....it is not like I won the money at some shady casino in Vegas - hahaha. I am sure the hotel I stay I won the the money has done the proper paperwork and submitted it to the IRS.

I look forward to hearing any thoughts and advice....hopefully someone on this sight will have helpful info.

I will be filing for the first time after winning 2 HP's this year. I hope I have better luck than you in getting it paid out quickly..

I just found this website and it seems as though there are quite alot of people in the same boat. I have never had an issue before and received my refund within 2 - 3 months of filing. The frustrating part is how rude they are when you call and they have no answers. Wonder what the interest is on the money they are withholding...

Thought that really sucks especially for my friend Touche who has over around $20,000 he is supposed to get back in the taxes he has been waiting for him since last year sometime how do they expect to get Canadian tourist down to gamble if they're going to keep pulling that shit

Sorry to hear this. But if you owe them, they'll hit you with hefty penalty fees and interest if you are late. Ba$tards!

It sucks big time! I would not mind so much if they actually gave me a legitimate reason and sent me a letter explaining their actions. The guy I spoke with was so rude and condescending. I guess the treaty means absolutely nothing.

Mine were all at the Wynn - I am pretty sure they submit all the proper paperwork. It is actually happening to alot of Canadians and it does not matter where they gamble in the States.

Why do they even take that money out? Can't you refuse the withholding? I don't get it, why can they do that?
