View Full Version : How much more frustrating can the irs be!!!!!

Good Afternoon!

I am hoping that someone else on this forum will have some helpful info.

Long story short - my husband I won some hand pays in Vegas for the 2014 year - being Canadian we filed all the correct forms with all the correct information. Well our IRS certified accountant did and sent them off. We have now been waiting over a year for our refund. We did receive letter's in December informing us that our refund would now be issued in 6 months with interest. Frustrating...but okay whats another 6 months.

Three day's ago my husband received a letter to notify him that they have eliminated the amount shown on the Form 1040NR, US Nonresident Alien Income Tax Return, Line 62 in the amount of...and that the information we supplied does not match the information they had received from the 1042-S, Foreign Person's US Source Income Subject to Withholding, filed by your withholding agent. (The Wynn)

Today I received the exact letter!!!!!

When our accountant contacted the IRS the other day and asked them to explain...they could not and they also stated they could not find my husbands papers. As if! Is no one accountable at the IRS and how is this legal?

Sorry for the rant, but it is a nice chunk of change they are withholding from us.

If any other Canadians are having the same experience - please let us know how you are or have dealt with this issue.

That's terrible. Hopefully it's some sort of glitch but with the corrupt dummies heading the IRS, they might have just enacted a new regulation to try to screw you out of it. Maybe they hope you'll give up. Our country is $19T in debt and counting so anything can happen. Sounds like a sure fire way to screw up tourism IMO.

I got an IRS audit letter today. (I'm also Canadian) for my 2014 return that is now 2 yrs owing. I need to provide proof of losses (slots - i mean WHO wins lol)
They also won't allow one of my 1042 forms because they don't have the supporting doc from the Casino. This was for $1700. Total and utter bullshit.
Tryster is right though, If this continues this way and I'm not given the money I'm owed then i have already gambled my last cent in the US.

Sorry to hear that Canadians are having a rough time of it. But I can assure you that if you owed the IRS money they would surely collect it pronto. This much I know, and treyster is right - the U.S. Treasury is beyond broke and has been technically bankrupt for quite a few years. It's all about to come to a head though. If anyone cares to follow the carnage you can check out the website "Zero Hedge".

I have the same problem...as if they lost it. I agree with you - what is the point of giving them our money that they are not supposed to take? Have you contacted them again? I contacted the Wynn and they are resending our info and they told me that this was not the first phone call of this nature they have had this week. Keep me posted...

I talked to RMS who is doing my refund. Apparently, 2014 returns are heavy on audits. They are telling me its because the casinos have been slow to remit the withholdings themselves (which also explains why so many missing slips)
Anyway, i literally have to print up all my banking info from 2 years ago. Joy.

For years the IRS easily refunded Cdns. It seems those days are over. I know this one accountant in Toronto that would easily get you your money back for a flat fee of $200.

Need to speak to her to see if its still as easy.

This is why I love going down to the Bahamas no taxes or forms.

yeah it is a bunch of bs if they are going to start pulling this. I am sure they casinos in vegas will heard it big time from their big canadian players!
hell i am pissed for you guys such BS you have to wait longer then after intial part of the year after losses were held IMHO

no taxes for any one right? if so great!

The IRS is blaming the casinos and saying they are submitting the forms....as if. We did use a certified IRS accountant and had no problem in the past. They even went as far to say that they lost the paperwork. I actually feel sorry for the people that answer the phone at the IRS, as they must get crapped on daily. Thanks for the tip about the Bahamas!!!

I know...we just spoke to the IRS and again it was a different story.

They said that the Wynn did not submit the forms....and that the Wynn needs to submit a copy of the original form - a 1042S....which is not possible as they have sent their copy and we have sent a copy....however we still have one left - so perhaps we will take it with us on our trip next week and get the Wynn to resend it. Last week they said they cannot find it. In June/July all was good - we would get the refund in December, in December the letter they sent to us said our refund would take a bit more time and it could be six more months....and now it is just NO, do not have it, pass the buck and sorry sucker - we are not issuing you your money. Still going to fight it.

Katdancer I was thinking that perhaps you could ask your host to help you with the paperwork? Also if it's a large enough sum maybe your host could refer a tax specialist to assist in resolving your refund?

It seems to me Wynn should be in a position to help you.

We will be speaking with our host next week for sure. We did use a tax specialist...but thanks for the reply - see you soon! Hahaha!
